A recent decision – 24th February 2025 and a very welcome one.

Everything that the employer did which wasn't in the Covid-19 Public Health Response (Vaccinations) Order 2021 was a breach of contract. The Order never said you could terminate people too. This is a recent decision in the Employment Court that's very good. Para 33 "the Order did not mandate termination of her employment". There was nothing in the vax Order about firing people(!) para 120 :" To suggest that by not being vaccinated, Ms Wills was at fault is not accepted. There was no legal requirement for her to be vaccinated. It is not open to the Court to find that she was required to take that step by way of mitigation. Such a finding would be inconsistent with Mr Wills's fundamental human rights..( footnote 38) 38.
